SANTA’S TROPICAL EXPRESS COMPETITION

TERMS AND CONDITIONS

1. PROMOTER AND COMPETITION OPERATOR

1.1 Promoter: This competition is promoted by Smithfield Shopping Centre (“the Centre”), managed by JLL Property Services Pty Ltd ABN 80 291 911 052 (“JLL”) on behalf of the Centre’s owners.

1.2 Transport Operator: Bus services are provided by Experience True Adventure Pty Ltd ABN 98 678 829 788 (“the Bus Operator”) under separate terms of carriage.

1.3 Participant Acknowledgment: By entering this competition, participants acknowledge they will be bound by both these competition terms and the Bus Operator’s Standard Conditions of Carriage.

2. COMPETITION PERIOD AND KEY DATES

2.1 Competition opens: 1 November 2025
2.2 Competition closes: 10 November 2025
2.3 Winners judged and announced: 10 November 2025
2.4 Prize acceptance deadline: 12 November 2025
2.5 T-shirt collection commences: 14 November 2025
2.6 Bus experience date: 15 November 2025

3. ELIGIBILITY REQUIREMENTS

3.1 Entry is open to Australian residents aged 18 years and over only.

3.2 The following persons are not eligible to enter:

• Employees of JLL Property Services Pty Ltd, Smithfield Shopping Centre, the Centre’s owners, Experience True Adventure Pty Ltd, and their immediate families
• Directors, contractors, and agents of the above entities

3.3 Each entrant may only enter once.

3.4 Entrants must be able to legally supervise children and accept full duty of care responsibilities.

4. ENTRY REQUIREMENTS – COMPETITION OF SKILL

4.1 This is a competition of skill judged on merit. Chance plays no part in determining winners.

4.2 To enter, entrants must write in 50 words or less why they want to join Santa’s Tropical Express, demonstrating creativity, originality, and genuine enthusiasm.

4.3 Entrants must provide accurate t-shirt sizes for each child if selected as winners.

4.4 Entries that do not meet the skill criteria or word limit will be disqualified.

5. PRIZE DETAILS AND STRUCTURE

5.1 The prize consists of up to three (3) tickets for Santa’s Tropical Express experience.

5.2 Prize MUST include exactly:

• One (1) adult aged 18 years or over (the winner)
• Up to two (2) children aged 17 years or under

5.3 Each child receives one (1) complimentary t-shirt serving as their bus entry ticket.

5.4 Winners select their preferred pick-up location from:

• Yorkeys Knob (departure 9:00am)
• Trinity Beach (arrival approximately 9:30am)
• Kewarra Beach (arrival approximately 10:00am)

5.5 The bus experience concludes at Smithfield Shopping Centre (arrival approximately 10:30am).

5.6 IMPORTANT: The bus does NOT return to original pick-up locations. Winners must arrange their own return transport from Smithfield Shopping Centre.

5.7 The prize has no cash value, is non-transferable, and cannot be exchanged.

6. BUS EXPERIENCE SPECIFICATIONS

6.1 Experience date: 15 November 2025

6.2 Bus features: Two-level vehicle with upper and lower decks *please note upper deck is open

6.3 Capacity: Strictly limited to 70 passengers

6.4 Passenger Restrictions: NO additional persons permitted beyond the specified prize entitlements, including babies, infants, additional family members, or guardians.

6.5 Exact pick-up locations provided to winners upon selection.

7. PRIZE ACCEPTANCE AND COLLECTION

7.1 Winners must accept prizes before 12 November 2025 or forfeit entitlement.

7.2 T-shirts available for collection from Customer Service Desk from 14 November 2025 between 9am to 3pm.

7.3 Failure to collect t-shirts or attend the bus experience results in prize forfeiture.

7.4 No alternative dates, times, or compensation available for non-attendance.

8. SUPERVISION AND DUTY OF CARE

8.1 The adult winner accepts complete and sole responsibility for supervising accompanying children throughout the entire bus experience.

8.2 This includes but is not limited to:

• Ensuring children follow all safety instructions
• Preventing unsafe behavior
• Supervising children on the upper deck if accessed
• Maintaining constant care and attention

8.3 The adult winner must remain with and actively supervise children for the duration of the experience.

8.4 Winners participate entirely at their own risk.

9. SAFETY REQUIREMENTS AND RECOMMENDATIONS

9.1 Mandatory Safety Compliance:

• All passengers must follow driver instructions at all times
• Only one person per seat – no standing, lap-sitting, or seat-sharing
• No glass items of any kind permitted on bus
• Smoking, vaping, and illegal substances strictly prohibited

9.2 Strongly Recommended:

• Children wear sunscreen and sun-safe clothing
• Bring appropriate hydration
• Follow all bus operator safety protocols

9.3 The driver has absolute authority over bus safety and may remove passengers for safety violations.

10. TRANSPORT CONDITIONS AND COMPLIANCE

10.1 Bus services operate under Queensland transport regulations and Experience True Adventure Pty Ltd’s Standard Conditions of Carriage.

10.2 The Bus Operator may:

• Refuse carriage for safety reasons
• Alter routes due to traffic, weather, or road conditions
• Cancel or delay services for mechanical or safety reasons

10.3 Winners are bound by all applicable transport regulations and conditions of carriage.

11. LIABILITY AND RISK ALLOCATION

11.1 Australian Consumer Law Notice: Nothing in these terms excludes, restricts, or modifies rights under the Australian Consumer Law that cannot be lawfully excluded.

11.2 Liability Limitation: Subject to clause 11.1, and to the maximum extent permitted by law, Smithfield Shopping Centre, JLL Property Services Pty Ltd, the Centre’s owners, and Experience True Adventure Pty Ltd accept NO responsibility for any injury, loss, theft, damage, or incident during the bus experience.

11.3 Participant Assumption of Risk: By participating, winners acknowledge they:

• Understand the inherent risks of bus travel and group activities
• Participate voluntarily and at their own risk
• Release all parties from claims arising from participation

11.4 Indemnification: Winners indemnify all parties against claims arising from their participation or failure to comply with these terms.

12. FORCE MAJEURE AND CANCELLATION

12.1 The Promoter and Bus Operator are not liable for failure to perform due to circumstances beyond reasonable control, including:

• Severe weather conditions
• Mechanical breakdown
• Road closures or traffic incidents
• Government restrictions or public emergencies
• Acts of God

12.2 In such circumstances, reasonable efforts will be made to reschedule or provide alternatives, but no compensation is payable.

13. MEDIA CONSENT AND PRIVACY

13.1 By entering, participants consent to use of their name, image, and likeness for promotional purposes including social media, photography, and marketing materials.

13.2 Personal information is collected solely for competition and promotional purposes and handled according to Australian Privacy Principles.

13.3 Winners agree to participate in reasonable promotional activities as requested.

14. GENERAL CONDITIONS

14.1 The Promoter reserves the right to:

• Verify eligibility and require proof of identity and age
• Disqualify entries not complying with these terms
• Modify terms for legal or operational reasons with reasonable notice

14.2 The Promoter’s decisions regarding entries and winners are final – no correspondence will be entered into.

14.3 These terms, together with booking confirmations, form the entire agreement.

14.4 Variations must be agreed in writing by the Promoter.

15. DISPUTE RESOLUTION

15.1 Disputes should first be raised with Smithfield Shopping Centre Management.

15.2 If unresolved, disputes may be referred to the Queensland Office of Fair Trading or relevant consumer protection agency.

15.3 Legal proceedings may only be commenced in Queensland courts.

16. GOVERNING LAW

These Terms and Conditions are governed by Queensland law. Participants submit to Queensland court jurisdiction for any disputes.

17. CONSUMER PROTECTION NOTICE

Important: You have rights under Australian Consumer Law that cannot be excluded. For information about your consumer rights, visit www.accc.gov.au or contact the Australian Competition and Consumer Commission.
